Dangerous compounds
Ministry of Health circular, 7th January 2004
Detailed instructions for the application of Legislative Decree n° 65 dated 14th March 2003, implementing Directive 1999/45/EC of the European Parliament and Council, dated 31st May 1999, and Directive 2001/60/EC of the European Commission, dated 7th August 2001, concerning the classification, packaging and labeling of dangerous compounds.
Legislative Decree n° 65/2003 forms the new general rules for the classification, packaging and labeling of dangerous compounds.
It completely replaces the previous rules (Leglislative Decree n° 285 dated 16th July 1998), abrogating this for good in order to make it easier to apply, on an operative level and as a single set of rules, for both those to whom it is addressed and those responsible for ensuring its correct application.
The complexity of the envisaged measures, plus the fact that these are new to certain sectors of production, means significant changes in the organisation of those expected to apply the new rules and so the Ministry of Health has seen fit to prepare this useful and necessary tool of interpretation.

Food for special diets

Labeling of meat
Legislative Decree n° 58, dated 29th January 2004
Penalties for violation of EC Rules numbers 1760 and 1825, dated 2000, concerning the identification and registration of beef cattle, plus the labeling of beef and beef derived products, in accordance with article 3 of Law n° 39 dated 1st March 2002.
The current decree explains the main penalties for violation of the rules concerning:
a) the supply and affixation of ear tags on beef cattle (Decree of the President of the Republic n° 437, dated 19th October 2000; Decree of the Ministers of Health and of Agriculture and Forestry, dated 31st January 2002);
b) the labeling of beef and beef-based products (Law n° 39, 1st March 2002).

Labeling, presentation and advertising of food products
Circular of the Minister of Industry n° 168, dated 25th March 2004
This circular integrates and replaces letter H) of circular n° 168 dated 10th November 2003, concerning fantasy drinks, as the previous wording led to incorrect interpretation.
More specifically, fantasy drinks must be produced in compliance with the provisions of Presidential Decree n° 719/1958.
As a result, such drinks may be prepared with or without the addition of fruit juice, at a rate of less than 12%, and must be presented with a retail name and in such a way that there is no risk of confusion with other types of drink.

Preparati pericolosi
Circolare Ministero della salute 7 gennaio 2004
Indicazioni esplicative per l'applicazione del decreto legislativo del 14 marzo 2003, n. 65, di recepimento della direttiva 1999/45/CE del Parlamento europeo e del Consiglio del 31 maggio 1999 e della direttiva 2001/60/CE della Commissione del 7 agosto 2001, concernente la classificazione, imballaggio ed etichettatura dei preparati pericolosi.
Il decreto legislativo n. 65/2003 rappresenta la nuova normativa quadro in materia di classificazione, imballaggio ed etichettatura dei preparati pericolosi.
Esso ha riscritto in maniera completa la vecchia disciplina (decreto legislativo 16 luglio 1998, n. 285) abrogandola definitivamente per facilitare, a livello operativo e mediante un testo consolidato, l'attività tanto di coloro cui il decreto medesimo e' diretto, quanto di coloro cui e' deputata la valutazione della corretta applicazione dello stesso.
La complessità degli adempimenti previsti, abbinata alla novità degli stessi per alcuni settori produttivi, comportano per i destinatari della norma un notevole sforzo organizzativo e per questo motivo il Ministero della salute si è reso disponibile a fornire questo utile e necessario strumento interpretativo.

Alimenti per alimentazione particolare

Elenco degli stabilimenti autorizzati, alla data del 29 febbraio 2004, alla produzione ed al confezionamento degli alimenti destinati ad un'alimentazione particolare.

Etichettatura carni
Decreto Legislativo 29 gennaio 2004, n.58
Disposizioni sanzionatorie per le violazioni dei Regolamenti (CE) numeri 1760 e 1825 del 2000, relativi all'identificazione e registrazione dei bovini, nonche' all'etichettatura delle carni bovine e dei prodotti a base di carni bovine, a norma dell'articolo 3 della legge 1° marzo 2002, n. 39.
Il decreto in esame enuclea le principali sanzioni relative alla violazione delle norme in materia di:
a) fornitura e apposizione di marchi auricolari sugli animali della specie bovina (Decreto del Presidente della Repubblica 19 ottobre 2000, n. 437; Decreto dei Ministri della salute e delle politiche agricole e forestali 31 gennaio 2002);
b) etichettatura delle carni bovine e dei prodotti a base di carni bovine (Legge 1° marzo 2002, n. 39).

Etichettatura, presentazione e pubblicità dei prodotti alimentari
Circolare Ministero delle attività produttive 25 marzo 2004, n.168
La circolare integra e sostituisce la lettera H) della circolare n. 168 del 10 novembre 2003, per quanto riguarda le bevande di fantasia, poiché vi era state interpretazioni erronee.
In particolare le bevande di fantasia devono essere prodotte in conformità alle disposizioni del DPR 719/1958.
Di conseguenza possono essere preparate con o senza aggiunta di succo di frutta, in quantità inferiore al 12% e devono essere presentate con denominazione di vendita e modalità tali da non creare confusione con altre bevande.
