Flour and pasta products
Decree of the Ministry of Agriculture and Forestry 29 November 2002
Amendments to Inter-Ministerial Decree dated 26 April 2002 bearing provisions applying article 12, paragraphs 2, 3 and 4 of Presidential Decree n° 187 dated 9 February 2001 concerning a review of the standards for the production and sale of flour and pasta products.
Subjects intending to produce flour and pasta products as per article 12, paragraph 4 of Presidential Decree n° 187/2001 must send an application on unstamped paper to the Ministery of Agriculture and Forestry via registered post with recorded delivery, filling out the form enclosed in Attachment 1 (Form PT/1), indicating the type of packaging one intends to use and the corresponding number of the examples enclosed.
Two exemplars of the type of pack to be used for each brand must be enclosed with the application. In the event of a brand with different formats, one need enclose just two examples for a single format. Example: if there are three formats for long pasta and two formats for short pasta, both belonging to the same brand, just four examples need to be enclosed (two packs for the long pasta format and two for the short pasta format).

Labeling of special food
Decree of the Ministry of Health, 9 October 2002
Amendment to Ministerial Decree dated 25 July 2002, concerning the mention of the notification procedure for labels as per article 7 of Legislative Decree dated 27 January 1992, n° 111.
In view of the significant needs reported by operators in this sector, this decree extends the deadline for producers of products destined for inclusion in special diets to indicate a mention of said notification being made on the product label or other suitable information tool from ninety days to a hundred and eighty days from the date of the present decree coming into force.

Classification, packaging and labeling of hazardous substances
Decree of the Ministry of Health, 12 December 2002
Correction to Ministerial Decree dated 14 June 2002, bearing implementation of European Directive 2001/59/EC containing the 28th amendment to Directive 67/548/EEC to reflect technological progress, concerning the classification, packaging and labeling of hazardous substances.
Deemed necessary to avoid the risk of errors in processing orders once the Decree dated 14 June 2002 comes into force, published on the Official Gazette, Ordinary Supplement n° 244 dated 17/10/2002, it is hereby specified that the latter is deemed to come into effect on the thirtieth day after publication in the case of hazardous substances and preparations that fall outside the field of application of Legislative Decrees n° 194 dated 17 March 1995 and n° 174 dated 26 February 2000.

Decree of the Ministry of Health, 9 January 2003
Correction to Enclosure III of Ministerial Decree dated 14 June 2002, implementing European Directive n° 2001/59/EC bearing the 28th amendment to Directive 67/548/EEC to reflect technological progress, concerning the classification, packaging and labeling of hazardous substances.
Given that Enclosure III of Ministerial Decree dated 14 June 2002 does not include the hazard wording R 68 in the general list of risk warnings, though this is already present in the combination of several R warnings contained in the same enclosure, the following phrase is added to the "list of risk warnings" in said enclosure: R 68 possibility of irreversible effects.

Environmental statement single form
Decree of the Premier, 24 December 2002
Approval of the new single form to be used for 2003 environmental statements.
Having considered the need to simplify the measures arising from the obligation to make such a statement and in view of the need to clarify the manner in which the obligation to make an annual statement and report on waste products produced and managed should be performed, given that the reference standards have changed substantially in recent years, this decree replaces the old form enclosed in the decree dated 31 March 1999 with the new one in the Enclosure. The new form adopted with this decree shall be used for all statements to be presented by 30 April 2003 and referring to 2002 by all interested subjects.

Trade in products
Commission directive 2002/86/CE of 6 November 2002
including modification of directive 2001/101/CE regarding the deadline from which the trade in products which do not conform to directive 2000/13/CE of the European Parliament and Council is forbidden.
The Commission modifies directive 2001/101/CE concerning the deadline from which the trade in products which do not conform to directive 2000/13/CE is forbidden, regarding labeling, presentation and advertising of food products. This modification is rendered necessary with the aim of granting a suitable transitory period to enable the labeling of meat-based products to conform.
The new deadlines are:
- starting from 1 January 2003 for the authorisation of trade in products conforming to directive 2000/13/CE;
- starting from 1 July 2003 for the ban on trade in products which do not conform to directive 2000/13/CE.
However, products which do not conform to this directive and labeling before 1 July 2003 are authorised until stocks are exhausted. The directive came into force on 28/11/2002.

Olive oil
Commission’s Regulation 1964/2002/CE of 4 November 2002 including modification of Regulation (CE) n. 1019/2002 relating to regulations for the marketing of olive oil.
With the objective of granting operators a sufficient interval to adapt to new conditions for the packaging and labeling of olive oil-based products, it is appropriate to extend the adaptation period as stated in article 12, paragraph 2 of regulation (CE) n. 1019/2002. In effect, this article should take effect from 1 November 2002, with the exception of articles 2, 3, 5 and 6 which will take effect from 1 November 2003. The Regulation came into force on 9/11/2002.

Food additives
Directive 2002/82/CE: of the Commission of 15 October 2002
including modification of Directive 96/77/CE, which establishes the requirements for the specific purity of the various food additives of colourings and sweeteners.
This modification is aimed at bringing into line with technical progress the existing criteria for purity established by directive 96/77/CE and to fix new criteria for food additives where the previous criteria were inadequate.
The directive came into force on 27/11/2002.

Phthalates
Decision of the commission of 18 November 2002 which modifies decision 1999/815/CE concerning measures which forbid the placing on the market of toys and youth culture articles intended to be placed in the mouth of children under the age of three and made of soft PVC containing phthalates.
In article 5 of decision 1999/815/CE the words "20 November 2002" are replaced by the words "20 February 2003".

Waste
Regulation 2150/2002/CE of the European Parliament and Council of 25 November 2002, concerning statistics on waste.
This regulation is necessary to develop statistical tools to evaluate respect for the principle of prevention of waste and to link, at a global, national and regional level, the data relating to the production of waste with the description of use. This regulation came into force on 30/12/2002.

Sfarinati e paste alimentari
Decreto Ministero delle Politiche Agricole e Forestali 29 novembre 2002
Modifiche al decreto interministeriale 26 aprile 2002, recante disposizioni applicative dell'art. 12, commi 2, 3 e 4 del decreto del Presidente della Repubblica 9 febbraio 2001, n. 187, concernente la revisione della normativa sulla produzione e commercializzazione di sfarinati e paste alimentari. I soggetti che intendono produrre sfarinati e paste alimentari ai sensi dell'art. 12, comma 4 del decreto del Presidente della Repubblica n. 187/2001 devono inviare, a mezzo raccomandata con avviso di ricevimento indirizzata al Ministero delle politiche agricole e forestali, domanda in carta libera compilando lo schema di cui all'allegato 1 (Mod. PT/1), indicando il tipo di confezionamento che si intende utilizzare ed il numero corrispondente degli esemplari allegati.
Le confezioni, per ogni marchio, devono essere allegate in due esemplari allegati. In caso di marchio con formati diversi sarà sufficiente allegare soltanto due esemplari relativi a un unico formato. Esempio: in caso di tre formati a pasta lunga e di due formati a pasta corta, relativi a uno stesso marchio, sarà sufficiente allegare solo quattro esemplari (due confezioni con formato a pasta lunga e due con formato a pasta corta).

Etichettatura di alimenti particolari
Decreto Ministero della Salute 9 ottobre 2002
Modifica al decreto ministeriale 25 luglio 2002, relativo alla citazione della procedura di notifica di etichetta, ai sensi dell'art. 7 del decreto legislativo 27 gennaio 1992, n. 111. Tenendo conto di importanti esigenze segnalate , il decreto ha sostituito da novanta a centottanta giorni dalla data di entrata in vigore del presente decreto, il termine entro il quale le aziende che producono prodotti destinati a un'alimentazione particolare, devono riportare nell'etichetta del prodotto o in un altro strumento informativo la citazione dell'avvenuta notifica.

Classificazione, imballaggio ed
etichettatura di sostanze pericolose
Decreto Ministero della Salute 12 dicembre 2002
Rettifica al decreto ministeriale 14 giugno 2002, recante il recepimento della direttiva 2001/59/CE recante XXVIII adeguamento al progresso tecnico della direttiva 67/548/CEE, in materia di classificazione, imballaggio ed etichettatura di sostanze pericolose. Ritenuto necessario ovviare ad eventuali disguidi in ordine alla data di decorrenza del decreto 14 giugno 2002, pubblicato su: Gazz. Uff. Suppl. Ordin. n° 244 del 17/10/2002, viene precisato che quest’ultimo entrerà in vigore a decorrere dal trentesimo giorno dopo la pubblicazione per le sostanze pericolose e per i preparati che esulano dal campo di applicazione dei decreti legislativi 17 marzo 1995, n. 194, e 26 febbraio 2000, n. 174.

Decreto Ministero della Salute 9 gennaio 2003
Rettifica dell'allegato III al decreto ministeriale 14 giugno 2002, di recepimento della direttiva n. 2001/59/CE recante XXVIII adeguamento al progresso tecnico della direttiva n. 67/548/CEE, in materia di classificazione, imballaggio ed etichettatura di sostanze pericolose. Considerato che l'allegato III al decreto ministeriale 14 giugno 2002 non include nell'elenco generale delle frasi di rischio la frase di rischio R 68, per altro già presente nelle combinazioni di più frasi R contenute nello stesso allegato al predetto allegato "elenco delle frasi di rischio" viene aggiunta la seguente frase: R 68 possibilità di effetti irreversibili.

Modello unico di dichiarazione ambientale
Decreto Presidente del Consiglio dei Ministri 24 dicembre 2002
Approvazione del nuovo modello unico di dichiarazione ambientale per l'anno 2003. Valutata l'esigenza di semplificare gli adempimenti derivanti dagli obblighi di dichiarazione e considerata, altresì, l'esigenza di chiarire le modalità di assolvimento degli obblighi di dichiarazione e di comunicazione annuale in materia di rifiuti prodotti e gestiti in presenza di una normativa di riferimento mutata nel corso degli ultimi anni, il presente decreto sostituisce con un nuovo modello in allegato, quello vecchio presente nel decreto del 31 marzo 1999. Il modello adottato con il presente decreto sarà utilizzato per le dichiarazioni da presentare, entro il 30 aprile 2003, con riferimento all'anno 2002, da parte dei soggetti interessati.

Scambi di prodotti
Direttiva 2002/86/CE della Commissione del 6 novembre 2002 recante modifica della direttiva 2001/101/CE per quanto concerne il termine a partire da cui sono vietati gli scambi di prodotti non conformi alla direttiva 2000/13/CE del Parlamento europeo e del Consiglio.
La Commissione modifica la direttiva 2001/101/CE per quanto concerne il termine a partire da cui sono vietati gli scambi di prodotti non conformi alla direttiva 2000/13/CE riguardante etichettatura, presentazione e pubblicizzazione dei prodotti alimentari. Tale modifica si è resa necessaria al fine di concedere un opportuno periodo transitorio grazie al quale conformare l'etichettatura dei prodotti a base di carne. Per cui i nuovi termini sono:
- a partire dal 1° gennaio 2003 per l’autorizzazione degli scambi dei prodotti conformi. alla direttiva 2000/13/CE;
- a partire dal 1° luglio 2003, per il divieto degli scambi di prodotti non conformi alla direttiva 2000/13/CE.
Tuttavia i prodotti non conformi alla presente direttiva ed etichettati prima del 1° luglio 2003 sono autorizzati fino ad esaurimento delle scorte. La direttiva è entrata in vigore il giorno 28/11/2002.

Olio d'oliva
Regolamento 1964/2002/CE della Commissione del 4 novembre 2002 recante modifica del Regolamento (CE) n. 1019/2002 relativo alle norme di commercializzazione dell'olio d'oliva.
Allo scopo di accordare agli operatori un lasso di tempo sufficiente per adattarsi alle nuove condizioni di imballaggio e di etichettatura di prodotti a base di olio d’oliva, è opportuno prolungare il periodo di adattamento di cui all'articolo 12, paragrafo 2, del regolamento (CE) n. 1019/2002. In sostanza il predetto articolo si applica a decorrere dal 1° novembre 2002, fatta eccezione per gli articoli 2, 3, 5 e 6 che sono applicabili a decorrere dal 1° novembre 2003.
Il Regolamento è entrato in vigore il giorno 9/11/2002.

Additivi alimentari
Direttiva 2002/82/CE: della Commissione del 15 ottobre 2002 recante modifica della Direttiva 96/77/CE, che stabilisce i requisiti di purezza specifici per gli additivi alimentari diversi dai coloranti e dagli edulcoranti. Questa modifica mira ad adattare al progresso tecnico i criteri di purezza esistenti stabiliti dalla direttiva 96/77/CE e a fissare nuovi criteri per gli additivi alimentari per i quali i precedenti criteri sono insufficienti. La direttiva entra in vigore il giorno 27/11/2002.

Ftalati
Decisione della commissione del 18 novembre 2002 che modifica la decisione 1999/815/CE riguardante provvedimenti che vietano l'immissione sul mercato di giocattoli e articoli di puericultura destinati a essere messi in bocca da bambini d'età inferiore a tre anni e fabbricati in PVC morbido contenente taluni ftalati. Nell’articolo 5 della decisione 1999/815/CE i termini "20 novembre 2002" sono sostituiti dai termini "20 febbraio 2003".

Rifiuti
Regolamento 2150/2002/CE del Parlamento europeo e del Consiglio, del 25 novembre 2002, relativo alle statistiche sui rifiuti. Tale norma è necessaria al fine di sviluppare strumenti statistici per valutare il rispetto del principio della prevenzione dei rifiuti e per collegare, a livello globale, nazionale e regionale, i dati relativi alla produzione di rifiuti con la descrizione dell'impiego. Il presente regolamento entra in vigore il giorno 30/12/2002.
